Tour de Clarksville, 5th Annual, Paddle the West Fork, 04/30/2016 Event The purpose of this event is to encourage interest and use of the Clarksville Blueways System. Come enjoy a day on the river with other paddle enthusiasts like yourself. Bring your kayaks & canoes down to Robert Clark Park 1449 Tiny Town Road and float down to Trice Landing 99 Oak Street, right through the center of the City! The entire route is 15 miles, 5-9 hours. For those that want a shorter route, you can exit from the float at Billy Dunlop park 1930 E Boyscout Road. This would only be 2 miles downstream. This route is long with about 7 miles of floatable water, 7 miles of flat water, and under 1 mile of paddling downstream on the Cumberland to Trice landing. This is a FREE event*! *For those that have their own boats and transportation, there is no cost to participate. REDUCED RENTAL AND TRANSPORT FEES FOR THIS EVENT For those that have their own boat but need a ride in our van for only (.99 +tx&f). For those that don't have kayak, we have kayaks for rent for only (.99 +tx&f). Lifevest & Personal Floation Devices are required per Tennessee State Laws. Transportation is limited and ultimately your responsibility.     TIMELINE OF EVENT - YOU MUST HAVE A COPY OF YOUR TICKET, paper version or smartphone screen is OK. 0700 – ROBERT CLARK PARK - We will have a person at Robert Clark Park 1449 Tiny Town Road. You can safely drop off your boats and extra passengers at the start point. Then Drivers can then take their vehicles either to Trice Landing, 99 Oak Street (14 mile trip) or to Billy Dunlop park 1930 E Boyscout Road (2 mile trip). For a .99 fee (+tx&f), we will drive you from your parked vehicle from Trice Landing at 0800, or from Billy Dunlop park at 0830, back to the start point of robert Clark park.   0800 – TRICE LANDING - Drivers who decided to park their vehicles at Trice Landing may ride in our van for a fee of .99 (+tx&f) per person. The van will depart Trice Landing 99 Oak Street at 0800 and will NOT wait for anyone. The van will then drive to Billy Dunlop Park 1930 E Boyscout Road. 0830 - BILLY DUNLOP PARK - The van will depart Billy Dunlop park 1930 E Boyscout road and immediately pick up anyone for .99 (+tx&f) per person for a ride up to Robert Clark park 1449 Tiny Town Road. 0850 - ROBERT CLARK PARK - Safety Meeting and introduction of event. 0900- ROBERT CLARK PARK - Entry of all boats into the water. START OF EVENT 1000-1100 - BILLY DUNLOP PARK - Passing by Billy Dunlop park, 2 miles into the event. Those wishing for a short trip must exit here because there are no other pull out points for the next 12 miles. Everyone else will continue down the river to Trice landing. 5-9 hours into the trip, the group will reach mile marker 0 of the West Fork and turn right onto the Red River and go downstream for about 1.25 miles. The group will then reach mile marker 0 of the Red River and turn right onto the Cumberland River. In about 6/10's of a mile (0.6 mile), Trice Landing ramp will be on the right. 1400-1800 (2p-6p) - Arrival of all remaining boats at Trice Landing. END OF EVENT     EVENT TICKETS - You must select one of these three ticket types to participate YOU MUST HAVE A COPY OF YOUR TICKET, paper version or  smartphone screen is OK Tour de Clarksville 04/30/2016 - FREE - if you have your own boat and vehicles, Van Ride Ticket - .99 +tx&f - For each person that has their own boat and just needs a ride from one park to another, OR Kayak Rental Single Seat - .99 +tx&f - per Person, To rent a kayak from us and get a free ride in our van.  Kayak and Van Seats are limited and will only honored thru a VALID ticket from EVENTBRITE.com.  YOU WILL BE REQUIRED TO SIGN A RELEASE OF LIABILITY AT THE EVENT. This event is organized solely by Blueway Adventure LLC, which has a contract to service in City Parks.  EVENT MAP     WAIVER & LIABILITY RELEASE - Must be signed at EVENT In consideration of the use of the property, facilities and/or services of Blueway Adventure LLC & The City of Clarksville: I/We the undersigned on any side of this document, agrees as follows: I/WE AGREE TO NOT PARTICIPATE IN NOR ENGAGE IN ANY LAWSUIT AGAINST BLUEWAY ADVENTURE, AND/OR THE CITY OF CLARKSVILLE FOR ANY REASON. INDEMNITY. The undersigned agrees to indemnify and defend Blueway Adventure, The City of Clarksville, and its officers, employees and agents (each, an "Indemnitee") and hold them harmless from any or all claims, causes of action, damage judgments, costs or expenses, including attorney fees which in any way arise from the undersigned participation in the Blueway Adventure Activities which include but are not limited to damages to or destruction of any property of an Indemnitee, of any others, injury or death of the undersigned or anyone else or any liability arising from the act or negligent act of an Indemnitee, the undersigned or anyone else; provided, and, the foregoing indemnity shall also apply to claims related to the gross negligence or willful misconduct of Blueway Adventure. MINOR CHILDREN & INCOMPETENT ADULTS The undersigned agrees to accept this agreement on behalf of any and all minor children, and any and all incompetent adults. WARNING. There are significant elements of risk in any adventure sport or activity associated with the use or presence water craft, including but not limited to water sports and the use of related equipment. These risks are inherent is all water sports and may be present even if the equipment is used properly and even in still water. SCOPE OF RELEASE. This Release of Liability covers all activities indirectly or directly associated with the use of Blueway Adventure equipment, facilities, services, and activities organized by, sponsored by, or directed by Blueway Adventure ("Blueway Adventure Activities"). RISK FACTORS. The undersigned understands and acknowledges that the Blueway Adventure Activities involve risks such as, but not limited to, the following: (i) changing water flow, conditions or current; (ii) collision with other participants, any portion of the interior of the craft, other water craft, manmade or natural objects, including overhanging, submerged and/or semi-submerged trees, branches, rocks and boulders; (iii) cold weather and heat related injuries and illnesses including hyperthermia, frostbite, heat exhaustion, sun stroke, and dehydration; (iv) inclement weather, variances and extremes of wind, weather and temperature, the presence of insects and animals; (v) sense of balance, physical coordination, ability to swim, and/or ability to follow directions; (vi) loss of control of the craft, collision, capsizing, and sinking of the craft which can result in wetness, injury, exposure to the elements, hypothermia and drowning; (vii) getting in and out of the craft; (viii) travel, including hiking, portaging and travel to and from the related and unrelated activities; (ix) the presence of wild animals, including marine life forms, (x) unavailability of emergency aid services and emergency medical care. The undersigned acknowledges that Blueway Adventure Activities, as well as other foreseeable or unforeseeable factors or circumstances, may result in a RISK OF PROPERTY DAMAGE, BODILY INJURY, AND POSSIBLY DEATH. ASSUMPTION OF RISK. By executing this Release of Liability, the undersigned expressly assumes all risk that arise from the participation in Blueway Adventure Activities, the acts of others, the unavailability of emergency care, and any other foreseeable or unforeseeable factors or circumstances related to the Blueway Adventure Activities. The undersigned assumes all risk of injury, wrongful death or property damage related to the Blueway Adventure Activities. ACKNOWLEDGMENT OF RULES, POLICIES AND PROCEDURES. The undersigned acknowledges that he or she has read and understood all of the rules, policies and procedures relating to Blueway Adventure Activities and understands that the safe and proper use of the facilities, equipment and participation in Blueway Adventure Activities is dependent upon carefully following such rules, policies and procedures. I agree to wear a properly fitted and fastened U.S. Coastguard approved flotation device while aboard a boat or on or in the water. The undersigned understands that water sports should only be undertaken after proper instruction and training and that Blueway Adventure is not providing such training in connection with the rental of equipment. The undersigned assumes full responsibility for deciding where, when and with whom to paddle. The undersigned acknowledges and agrees that the rental equipment provided by Blueway Adventure is for the sole and exclusive use of the undersigned and may not be used by any other person. The undersigned agrees to not use or be under the influence of any alcohol, illegal drugs or prescribed medications that may cause impairment. The undersigned agrees to hold Blueway Adventure harmless, if the undersigned violates any applicable laws while using Blueway Adventure equipment, activities, or facilities. PHYSICAL CONDITIONS AND SKILLS. The undersigned represents that he or she has the requisite skills, physical abilities and mental abilities necessary for proper and safe use of the Blueway Adventure equipment, facilities and services and to participate in the Blueway Adventure Activities. The undersigned agrees that if he or she has any questions as to what skills, qualifications or training are necessary to properly use the equipment or facilities, or to participate in the Blueway Adventure Activities, then they shall direct such questions to the appropriate staff member on site. RELEASE. The undersigned hereby releases, discharges, waives, disclaims and relinquishes all claims, actions or causes of action against Blueway Adventure and its officers, employees and agents and agrees not to sue them on account of or in conjunction with any claims, causes of action, injuries, damage, cost of expenses arising out of Blueway Adventure Activities, including those based on death, bodily injury or property damage whether or not caused by participation in Blueway Adventure Activities or the negligence of Blueway Adventure. WAIVER. The undersigned waives the protection afforded by any statute or law in any whose purpose, substance, and/or effect is to provide that a general release shall not extend to claims, material or otherwise which the person giving the release does not know of or suspect at the time of executing the release. This means, in part but not only, that the undersigned is releasing unknown future claims. PROPERTY DAMAGE. The undersigned agrees to pay for any or all damages to any property of Indemnitee caused by the undersigned either negligently, willfully, or otherwise. REPRESENTATIVES. The undersigned has executed this Release of Liability for himself or herself, and his or her heirs, assigns and legal representatives. EMERGENCY TREATMENT CONSENT. The undersigned, as a participant in the subject activity, hereby consents to medical treatment in a medical emergency where the undersigned is unable to consent to such treatment. INSURANCE. The undersigned understands that the Blueway Adventure does not carry participant insurance. The undersigned acknowledges that they either have appropriate insurance or, in it absence, agree to pay all cost of rescue and/or medical services as may be incurred on their behalf. SEVERABILITY. The undersigned agrees that if any provision or provisions of this Agreement shall be held to be invalid, illegal, unenforceable or in conflict with the law of any jurisdiction, the validity, legality and enforceability of the remaining provisions shall not in any way be affected or impaired thereby. ENTIRETY. This document is the entire agreement. This document is signed and executed in Montgomery County, in the State of Tennessee. No other venue is allowed.
